Twitter, which sued Musk to force him to complete the $44 billion acquisition, is seeking materials or testimonies to prove he is making excuses to leave because he changed his mind.
A lawyer on Twitter told the judge that it was difficult to obtain documents from the data scientists that Musk used to estimate the portion of fake accounts on the social network, and that what they finally obtained did not support his accusation that it was well above five percent.
Attorney Brad Wilson confirmed that Twitter experienced a "pattern of delays and obfuscations" when it came to what Musk learned from data scientists who studied Twitter data.

Musk's lawyers, in turn, lobbied the judge to get Twitter to hand over more messages or other material,

Especially in regards to 'Monetable Daily Active Users' and 'Active User Minutes'.
The session came during the discovery phase as rival parties seek documents, emails, testimonials and more to support their positions.

According to one of the documents, Tesla chief Musk will be sacked under oath over two days next week in sessions that will be recorded "by shorthand, audio and video."

One day the trial is scheduled to begin October 17 in Chancery Court in Delaware.

Musk, the world's richest man, said in a letter last April that he called off the deal because he was misled by Twitter about the number of bot accounts on his platform, allegations the company rejected.
He later added the accusations he made in a whistleblower complaint by the former Twitter security chief to his reasons for withdrawing from the deal.
Twitter stuck to its assessment of user numbers, and portrayed the whistleblower as a "disgruntled ex-employee" with unsubstantiated allegations.
"There are a range of possibilities that could come out of Delaware court including settlement, breakup fees paid, deal execution and a myriad of other outcomes," Wedbush analyst Dan Ives said of the trial.
