A writer who accused Donald Trump of raping her more than a quarter of a century ago plans to file a new lawsuit against the former US president, whose lawyer called the attempt "unusually biased."
In a letter published on Tuesday, E.
Jan Carroll said the former Elle columnist plans to sue Trump for batteries and willful infliction of emotional distress under New York State's Adult Survivors Act.

Carol's attorney Roberta Kaplan said her client plans to sue Trump on November 24 when state law takes effect, and that the allegations and the current defamation case that Carol has brought against Trump could take place together in February 2023.
In a letter replying to Kaplan, Trump's attorney, Alina Heba, said Trump "strongly" objected to the combination of the two cases,
After the parties have finished gathering evidence for the trial, it is "unusual bias" to add the new allegations.
“Allowing the plaintiff to radically change the scope and subject matter of this case at that time would severely harm the rights of the defendant,” Hobba wrote. "The plaintiff's request should be completely ignored."

Kaplan also said she now wants Trump to testify under oath upon filing, to better understand his "theory in the case", despite saying in February that the filing would not be needed.
"To be clear, the defendant's statement doesn't have to take long," Kaplan said.

Trump faces a host of lawsuits and investigations, including his efforts to back out of the 2020 US presidential election and refusal to hand over various documents.
In August, Trump invoked his constitutional right against self.
Incrimination more than 400 times during testimony by New York Attorney General Letitia James, who is conducting a civil investigation into the business practices of the Trump Organization of the same name.
Trump and Carroll are still awaiting a decision from the Federal Court of Appeals in Manhattan on whether Carroll's defamation case can proceed at all.
Carroll filed a lawsuit in November 2019 after Trump, who was in his third year in the White House, told a reporter that Carroll had made up the rape lawsuit and that he didn't know her and "she's not my type."
Trump has argued that he is protected from lawsuit by a federal law that provides immunity to government employees from defamation lawsuits.
